These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Wescott Trading.

4. Services Description
4.1 Custom Apparel Services
We provide custom printing and embroidery services on various apparel including but not limited to T-shirts, polo shirts, corporate uniforms, sportswear, jackets, caps, and promotional items.
4.2 Production Methods
Services include silk screen printing, heat transfer printing (DTF), embroidery, sublimation printing, and custom-made apparel production.
4.3 Minimum Order Quantities Important
5. Order Process
5.1 Quotation Request
Customers may request quotations through our Website, email, or phone. Quotations are valid for 14 days from issue date.
5.2 Order Confirmation
Orders are confirmed upon:
- Receipt of written confirmation from Customer
- Payment of required deposit (minimum 50% for new customers)
- Approval of final artwork proof
5.3 Artwork Submission
Customers must provide print-ready artwork in approved formats (AI, EPS, PDF, PSD). We reserve the right to charge artwork setup fees for files requiring modification.
5.4 Proof Approval Customer Responsibility
Digital proofs will be provided for Customer approval. Production will not commence until written approval is received. Customers are responsible for checking proofs for errors before approval.
6. Pricing and Payment Terms
6.1 Pricing
All prices are quoted in Malaysian Ringgit (MYR) unless stated otherwise.
Payment Terms
New Customers
50% deposit upon order confirmation, balance before delivery
Existing Customers with Credit Terms
50% deposit upon order confirmation, balance before delivery
6.3 Late Payment
Late payments are subject to:
- 1.5% monthly interest charge (18% per annum)
- Suspension of services until payment is received
- Recovery of collection costs and legal fees
6.4 Payment Methods
We accept bank transfer and online payment methods.
7. Intellectual Property Rights
7.1 Customer Artwork
Customers warrant that they own or have obtained proper licenses for all artwork submitted. Customers indemnify Wescott Trading against any claims arising from copyright or trademark infringement.
7.2 License Grant
Customers grant Wescott Trading a non-exclusive license to use submitted artwork solely for producing the ordered Products.
7.3 Wescott Trading Intellectual Property
All website content, logos, designs, and proprietary information remain our exclusive property. Unauthorized use is prohibited.
8. Production and Delivery
8.1 Production Time
Standard production time is 10-15 working days from proof approval. Rush orders are available at additional cost (subject to capacity).
8.2 Delivery
Shipping costs are borne by the Customer unless otherwise agreed.
8.3 Risk of Loss
Risk of loss or damage to Products transfers to Customer upon delivery to the shipping carrier.
8.4 Delivery Delays
We are not liable for delays caused by:
- Customer's late approval of proofs
- Force majeure events
- Courier service delays
- Public holidays
9. Quality Assurance and Returns
9.1 Quality Standards
All Products undergo a 3-point quality check:
- Stitching and construction quality
- Print/embroidery durability and alignment
- Fabric quality and color consistency
9.2 Defective Products Warranty
Customers must inspect Products upon delivery and report defects within:
- Manufacturing defects: 7 days from delivery
- Print/embroidery defects: 3 days from delivery
Defective Products will be replaced at our cost.
9.3 Non-Defective Returns
We do not accept returns for:
- Customer design errors
- Size/fit issues (unless incorrectly produced)
- Change of mind
- Customized Products (made to specifications)
9.4 Return Process
Return requests must include:
- Photographic evidence of defect
- Original invoice number
- Return authorization from our customer service
10. Limitation of Liability
10.1 Maximum Liability
Our maximum liability for any claim is limited to the purchase price of the affected Products.
10.2 Excluded Damages
We are not liable for:
- Consequential or incidental damages
- Loss of profits or business opportunities
- Third-party claims
- Design errors provided by Customer
10.3 Indemnification
Customers agree to indemnify and hold harmless Wescott Trading from any claims arising from:
- Copyright or trademark infringement
- Defamatory or illegal content in artwork
- Breach of these Terms
11. Dispute Resolution
11.1 Negotiation
Parties agree to attempt to resolve disputes through good faith negotiation for 30 days before initiating legal action.
11.2 Jurisdiction
These Terms are governed by Malaysian law. Disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
11.3 Mediation
Parties may opt for mediation through the Malaysian Mediation Centre before litigation.
Additional Terms
Force Majeure
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control including but not limited to natural disasters, government actions, labor disputes, supply chain disruptions, pandemic events, or utility failures.
Termination
By Customer: Orders may be terminated before production begins, subject to forfeiture of deposit if artwork setup has commenced.
By Wescott Trading: We may terminate services if Customer breaches these Terms, payment is overdue by more than 60 days, or bankruptcy proceedings are initiated against Customer.
Amendments
We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our Website. Continued use of our services constitutes acceptance of modified Terms.
